These Terms of Service (“Terms”) govern your access to and use of the website at whitetailhomesllc.com (the “Site”) operated by Whitetail Construction and Homes LLC (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Not professional or legal advice

Estimates, proposals, and contracts

Information on the Site—including descriptions of services, photos, and informal communications—is not an offer or binding quote. Pricing, scope, schedule, warranties, and other material terms are only binding when confirmed in a written agreement signed by both parties (or as otherwise agreed in writing). Oral statements alone do not override a written contract.

Intellectual property

Text, images, logos, and other materials on the Site are owned by us or used with permission. You may not copy, modify, distribute, or create derivative works from Site content without our prior written consent, except for temporary caching or printing a reasonable portion for personal, non-commercial reference.

Acceptable use

You agree not to:

  • Use the Site in any way that violates law or infringes others’ rights;
  • Attempt to gain unauthorized access to our systems, forms, or networks;
  • Transmit malware, spam, or abusive content through the Site or our contact channels;

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Whitetail Construction and Homes LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE (OTHER THAN CLAIMS GOVERNED BY A SEPARATE SIGNED CONSTRUCTION AGREEMENT) SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS OR (B) THE AMOUNT YOU PAID US SPECIFICALLY FOR SITE-RELATED SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnity

You agree to defend and indemnify us against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

Governing law and venue

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. For disputes solely related to the Site (not covered by a separate construction contract), you agree to the exclusive jurisdiction and venue of the state and federal courts located in Oklahoma County or the county where our principal place of business is located, except where prohibited by law.

Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after updates constitutes acceptance of the revised Terms.
